These Terms of Use ("Terms") constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you”) and SECOND WIND LIMITED ("we," "us," or "our"), concerning your access to and use of our mobile application, Bird Lens (the "Application").
By downloading, installing, or using the Application, you agree to be bound by these Terms. If you do not agree with these Terms, you are expressly prohibited from using the Application and must discontinue use immediately.
1. License
We grant you a revocable, non-exclusive, non-transferable, limited right to install and use the Application on a device owned and controlled by you, strictly in accordance with these Terms for your personal, non-commercial purposes.
2. Subscription Services
The Application offers services based on auto-renewing subscriptions.
- Subscription Title and Period: We offer options such as a "Monthly Subscription" and an "Annual Subscription." The specific subscription period and included features will be clearly displayed on the in-app purchase screen.
- Subscription Price: The price of the subscription will be displayed on the in-app purchase screen. All prices are subject to change.
- Payment and Renewal: Payment will be charged to your Apple ID or Google Play account at the confirmation of purchase. The subscription automatically renews unless it is canceled at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period.
- Managing Subscriptions: You may manage and cancel your subscriptions by going to your App Store or Google Play account settings after purchase.
3. User Conduct
You agree not to use the Application for any illegal or unauthorized purpose. You further agree not to, in any way:
- Reverse engineer, decompile, or disassemble any portion of the Application.
- Post any content that is harassing, defamatory, abusive, or otherwise objectionable.
- Infringe upon the intellectual property rights of others.
4. Intellectual Property
The Application and all of its content, including but not limited to software, text, images, trademarks, and logos, are the property of SECOND WIND LIMITED and are protected by intellectual property laws. You may not use, copy, or distribute any content without our prior written consent.
5. Privacy Policy

6. Termination
We may, in our sole discretion, suspend or terminate your right to access the Application, without prior notice, if you breach any of these Terms.
7. Disclaimer of Warranties & Limitation of Liability
THE APPLICATION IS PROVIDED ON AN "AS-IS" AND "AS-AVAILABLE" BASIS. WE MAKE NO WARRANTIES, EXPRESS OR IMPLIED, REGARDING THE APPLICATION. IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE APPLICATION.
8. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region.
